CONDITIONS OF PARTICIPATION

in the Mayrhofen Tourist Board photo contest

1. SCOPE OF APPLICATION:
These conditions govern participation in the Mayrhofen Tourist Board photo contest and are automatically accepted by all participants on entering the competition. Competition Organiser is the Mayrhofen Tourist Board, Durster Strasse 225, 6290 Mayrhofen, tel: 0043/5285/6760, E-Mail: info@mayrhofen.at.

 

2. ELIGIBILITY:
The competition is open to all natural persons of legal age and legal competence. Minors and/or those with limited legal capacity may only participate with the consent of their guardian or legal representative.

 

3. COMPETITION ADMINISTRATION:
Participation in the competition is free and can only be entered into via win.mayrhofen.at by uploading photos taken by the participant.

The duration of this competition including the deadline for entries and the prizes to be won will be published on this website. Every uploaded photo will be classified as a separate competition entry. Participants may upload multiple photos. The winner will be selected from all entries and informed of their win by the Mayrhofen Tourist Board by phone or email. If the winner cannot be reached using the email address provided, he/she shall forfeit any winnings to which he/she might otherwise have been entitled to and the winning draw will not be repeated.

It is not possible to redeem the prize in cash. Furthermore, prizes cannot be transferred to another person. The Organisers’ decision is final.

Mayrhofen Tourist Board reserves the right to terminate the competition prematurely without stating any reason.

4. RIGHTS OF THIRD PARTIES:
By uploading photos to win.mayrhofen.at, the participant confirms that he or she holds unlimited rights of use of all elements of the image.

Furthermore, the participant confirms to have the consent of the person(s) pictured, their guardians or legal representatives and that uploading the photo and its associated use does not violate any privacy rights of the person(s) depicted and that the person(s) concerned, their guardians or legal representatives agree with the publication of the photo. The participant shall confirm this in writing on request.

Should Mayrhofen Tourist Board be subjected to any third party claims, in particular for breach of privacy, abuse of competition, trademark or copyright infringement; the participant shall indemnify and hold Mayrhofen Tourist Board harmless against any loss, damage or claim sustained or raised in this respect.

5. RIGHTS OF USE, EXPLOITATION AND REPRODUCTION
By participating in the competition, the entrant grants Mayrhofen Tourist Board the non-exclusive and irrevocable license to use the submitted photos without time, space or content restrictions, as well as the right to edit and publish the uploaded photo.

 

6. DATA PROTECTION:
Each participant agrees to the use of personal information gathered during the course of the competition. This personal information will be treated confidentially by Mayrhofen Tourist Board and not disclosed to third parties.

Mayrhofen Tourist Board is entitled to use personal data collected during the course of the competition for the purpose of providing information on tourist offers from Mayrhofen Tourist Board and its members, customer satisfaction surveys as well as market research and can be processed and transferred automatically until further notice. This includes receiving information via electronic mail (email, SMS) and telephone contact. Written withdrawal from this consent is possible anytime by sending an email to marketing@mayrhofen.at or any other form of written communication to Mayrhofen Tourist Board.

7. DISCLAIMER:
Mayrhofen Tourist Board shall not be liable for any damages arising from participation in the competition or claims relating to the temporary unavailability of the Mayrhofen Tourist Board server.

 

8. MISCELLANEOUS:
Should any individual provisions of these conditions of participation become ineffective, inadmissible or impracticable, the validity of the remaining provisions shall not be affected. The invalid provision shall be substituted by an effective legal provision, which soonest complies with the whole purpose and commercial relevance of the invalid provision (severability clause).
